Terms & Conditions for the Use of the TPI Web Site


1. Introduction. This page contains the Terms and Conditions governing your use of the TPI Web Site and its services. Please read this page carefully. The following Terms and Conditions form a binding Agreement between the user and Technical Placement, Inc. (TPI). Your use of the TPI Web Site indicates your acceptance of these Terms and Conditions. If you do not accept these Terms and Conditions, you may not use the TPI Web Site.

TPI may revise the Agreement at any time by updating this page. Any use of the TPI Web Site or its services will be considered acceptance by you of the then-current Terms and Conditions. If at any time you find the Agreement unacceptable, you should no longer use the TPI Web Site.

The use of the TPI Web Site and its services is a privilege. TPI reserves the right to suspend that privilege on an individual basis for any reason at any time, in its sole discretion. Questions concerning the use of the TPI Web Site and its services should be directed to TPI Support.

In addition, the “look” and “feel” of the Site (including color combinations, button shapes, layout, design and all other graphical elements) are also protected by TPI's trademarks, service marks and copyrights. All other product and service marks contained on the Site are the trademarks of their respective owners.

4. Acceptable Use of the Site. The Site and its services are intended for individuals seeking employment and for employers or recruiters seeking candidates for employment. The Site may be used only for lawful purposes within this stated context of TPI's intended and acceptable use. TPI is the sole interpreter of its intended and acceptable use.

As one of the conditions of your use of the Site, you represent, warrant and agree that you will not use (or plan, encourage or help others to use) the Site for any purpose or in any manner that is prohibited by these Terms and Conditions or by applicable law. It is your responsibility to ensure that your use of the Site complies with these Terms and Conditions. In particular, acceptance of these Terms and Conditions indicates agreement with and submission to the following rules for posting, conduct and security on the Site.

Documents that encourage the User to "email for more details" are not permitted. Documents from any third party charging a fee or restricting complete access to all resume information are prohibited.

  5. Résumé postings must contain the accurate résumé of a living individual seeking employment on a full-time, part-time, or contractual basis on his or her own behalf.
TPI is under no obligation to monitor the Documents posted on the Site, but it may monitor Documents at random. Documents found to violate the above Posting Rules may be removed at TPI's discretion. Users who violate these Posting Rules may be denied access to the Site at TPI's discretion. TPI is the sole interpreter of the Posting Rules.

Conduct Rules:

  1. You may not respond to postings by other Users in any manner or for any purpose other than that which is expected (i.e., to apply for a job or to initiate further discussion with a candidate). Communications soliciting the employer's business by our competitors are prohibited.
  2. You may not send unsolicited commercial bulk email or bulk postal mail to TPI Users.
  3. Protect your password. You are responsible for maintaining the confidentiality of your information and password, and you are responsible for all uses of your registration, whether or not authorized by you. If others use your password to post inappropriate material on the Site, you risk losing your access to the service. You agree to notify TPI immediately of any unauthorized use of your registration and password.
  4. Report inappropriate postings or conduct to TPI Support.
  5. You may not delete or revise any material posted by any other person or entity.
TPI is under no obligation to monitor the conduct of its Users, but it may investigate and respond when violations are reported. Users who violate these Conduct Rules may be denied access to the Site at TPI's discretion. TPI is the sole interpreter of the Posting Rules.

Security Rules:
Users are prohibited from violating or attempting to violate the security of the Site, including, without limitation:

  1. accessing data not intended for such user or logging into a server or account which the user is not authorized to access;
  2. attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization;
  3. attempting to interfere with service to any user, host or network, including, without limitation, via means of submitting a virus to the Site, overloading, "flooding", "mailbombing" or "crashing";
  4. sending unsolicited e-mail, including promotions and/or advertising of products or services;
  5. forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting. Violations of system or network security may result in civil or criminal liability.
Violation of these Security Rules may result in civil or criminal liability. TPI will investigate occurrences which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations.

7. Indemnity.
You agree to defend, indemnify, and hold harmless TPI, it's officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from your use of the Site, the Content, any Document posted by you, or your breach of these Terms and Conditions. TPI shall provide notice to you promptly of any such claim, suit, or proceeding and shall assist you, at your expense, in defending any such claim, suit or proceeding.

Only TPI Business Partners & our clients seeking candidates to fill positions have access to any of your data. Information is never provided to a third party for use in a marketing program.

TPI may use the information it obtains relating to you, including your IP address, name, mailing address, email address and use of the Web Site, for its internal business and marketing purposes and may disclose the information to third parties searching for candidates. In addition, TPI reserves the right to comply, in its sole discretion, with legal requirements or requests relating to your use of the Site or its services or information you provide while using the Site or its services or which is provided to you or otherwise gathered by TPI with respect to such use.

9. General.
TPI is based in Montgomery County, Pennsylvania. The Company makes no claims that the Content is appropriate or may be downloaded outside of the United States. Access to the Content may not be legal by certain persons or in certain countries. If you access the Site from outside of the United States, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction. These Terms and Conditions are governed by the internal substantive laws of the State of Pennsylvania, without respect to its conflict of laws principles. Jurisdiction for any claims arising under this agreement shall lie exclusively with the state or federal courts in Montgomery County, Pennsylvania. If any provision of this Agreement is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect. No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term. Except as expressly provided in a particular "Legal Notice," or Software License or material on particular Web pages, this Agreement constitutes the entire Agreement between you and TPI with respect to the use of the Site. You understand and agree that, due to the nature of these Terms and Conditions, in addition to money damages, TPI will be entitled to equitable relief upon a breach of these Terms and Conditions by you.
